Cultura Connect

Rules for using CulturaConnect

Terms of Service

Effective October 2, 2026

These Terms apply to every CulturaConnect user. Business owners must also accept the separate Business Terms.

1. Acceptance of Terms

By downloading, installing, accessing, or using the CulturaConnect mobile application, website, or related services (the "Platform"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform. These Terms form a legally binding agreement between you and CulturaConnect LLC.

2. Modifications

We may update these Terms. We will revise the effective date and notify you of material changes through the app, email, or another appropriate method. We may require affirmative acceptance before continued use. If you do not agree to updated Terms, stop using the Platform and you may delete your account.

3. Key Terms

"User" includes customers and business owners. A "Listing" is a business profile. "User Content" includes photos, videos, audio, messages, reviews, posts, comments, events, and business information. A "Booking" is a reservation, appointment request, or enquiry; a request is not confirmed until the business confirms it.

4. Eligibility and Accounts

You must be at least 18 and able to form a binding contract. If acting for a business, you confirm you have authority to bind it. Provide accurate information, keep credentials private, and notify [email protected] of suspected unauthorized access. You are responsible for activity under your account and may not impersonate another person or use an account without permission.

5. Device Permissions

Optional features may request contacts, camera, selected media, microphone, foreground location, notifications, or motion. Contact phone numbers you choose are used to find existing members and are discarded after matching. Face ID and fingerprint checks are performed by your operating system; CulturaConnect does not receive biometric templates. Details are in the Privacy Policy.

6. Platform License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for personal use and, after accepting the Business Terms, to operate and promote your own business through authorized features. You may not resell the Platform, reverse engineer it, scrape it, bypass controls, or use it outside the permissions granted by these Terms.

7. User Content

You keep ownership of your User Content. You grant CulturaConnect a worldwide, royalty-free, non-exclusive license to host, store, format, resize, reproduce, and display it to the audience you select, and to permit service providers to do the same, solely to operate, secure, share, and improve the Platform. Public content may appear in public previews and Platform promotion; private content follows its access settings.

You confirm you have the necessary rights and that your content is lawful. We may remove content that violates these Terms and do not guarantee indefinite storage.

8. Prohibited Conduct

  • Fraud, impersonation, harassment, threats, discrimination, or illegal content.
  • Spam, unsolicited marketing, fake reviews, or harvesting personal information.
  • Malware, unauthorized access, scraping, disruption, or bypassing security and privacy controls.
  • Content that infringes intellectual-property, privacy, publicity, or other rights.

Violations may lead to content removal, restrictions, suspension, termination, or reporting to authorities.

9. Events, Groups and Invitations

Event creators are responsible for accurate details, lawful activities, attendee safety, and venue permissions. Invite links and private event information must be shared only with intended recipients. Users may not bypass access controls or redistribute private information without permission. CulturaConnect does not organize, supervise, insure, or guarantee user-created events.

10. Party Plans and Settlements

Party Plans record shared expenses and calculate suggested settlements. CulturaConnect does not hold, transfer, or collect money and does not guarantee that an expense, debt, or payment record is correct. Members must resolve disagreements and make payments using a method they independently choose. Anyone with a valid shared-report link may be able to view that report, so share it only with intended recipients.

11. Bookings, Reservations and Payments

CulturaConnect connects customers and businesses but is not a party to their service agreement. Businesses are responsible for accurate services, prices, availability, and policies. Customers must review listing and cancellation details. A business must honor confirmed bookings or promptly communicate changes.

Payments are arranged directly between the customer and business. CulturaConnect does not collect card or bank details, process or hold funds, set refund terms, or guarantee transactions. Confirm the business, amount, cancellation terms, and payment method before paying. Booking disputes are primarily between the customer and business, although CulturaConnect may assist at its discretion.

12. Business Listings and Business Terms

Listings may be approved, rejected, changed, suspended, or removed. Approval is not an endorsement or verification. Owners are responsible for licenses, permits, insurance, taxes, employment, accessibility, and consumer-protection duties. Business owners must accept the Business Terms, which control when they conflict with these Terms regarding business features.

13. Intellectual Property

The Platform, software, branding, design, and original content belong to CulturaConnect or its licensors. You may not use CulturaConnect marks without permission. Send infringement notices with sufficient detail to [email protected].

14. Disclaimers and External Services

CulturaConnect does not endorse or guarantee users, businesses, listings, services, events, or User Content and does not perform background or credential checks unless expressly stated. The Platform is provided "as is" and "as available" to the extent permitted by law.

External websites and social profiles are controlled by third parties. Payment links are not permitted in a listing's website field. CulturaConnect does not operate an in-app payment system. Independently confirm businesses and payment terms, do not pay based solely on an unsolicited message, and report suspected fraud.

15. Limitation of Liability

To the fullest extent permitted by law, CulturaConnect and its officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages arising from Platform use, User Content, bookings, events, party plans, external transactions, unauthorized access, or interruptions. Our total liability will not exceed the greater of $100 or amounts you paid CulturaConnect during the preceding twelve months. Some jurisdictions do not allow certain limitations.

16. Indemnification

To the extent permitted by law, you agree to defend and indemnify CulturaConnect from third-party claims, liabilities, damages, and reasonable expenses arising from your unlawful Platform use, User Content, bookings, business operations, violation of these Terms, or violation of another person's rights.

17. Suspension, Termination and Deletion

You may delete your account through Account > Security & Settings. We may restrict or terminate accounts for violations, fraud, safety risks, or harm to the Platform or community. Account deletion and limited retention are described in the Privacy Policy. Provisions concerning ownership, retained-content licenses, disclaimers, liability, indemnification, disputes, and general terms survive where their nature requires it.

18. Artificial Intelligence

Optional AI features assist with discovery, booking preparation, business descriptions, captions, translations, recommendations, and quizzes. OpenAI processes text you submit and limited listing context. AI can be inaccurate and does not confirm availability or provide professional advice. Verify output before relying on it, do not enter sensitive information, and review AI-generated content before publishing it.

19. Governing Law and Disputes

Texas law governs these Terms without regard to conflict-of-law rules, except where the law where you live requires otherwise. Before filing a claim, contact us and allow 30 days for informal resolution. Unless applicable law requires another forum, unresolved disputes must be brought in state or federal courts serving Collin County, Texas. Eligible individual small-claims cases and emergency injunctive relief may be brought in a court with jurisdiction.

20. General Provisions

These Terms, the Privacy Policy, and any applicable Business Terms are the entire agreement concerning the Platform. Invalid provisions are severed without affecting the remainder. Failure to enforce a provision is not a waiver. You may not assign your rights without consent; CulturaConnect may assign its rights as permitted by law.
